§ 17-2. Definitions.

  • As used in this Act [chapter]:

    (1)

    "Strip mining" means the process of a sifting, removal or movement of earth and extraction for commercial purposes of deposits of minerals or organic matter resulting in the creation of an open pit. It does not include removal or movement of earth or minerals incidental to development of land for purposes other than commercial production, or for mere testing, sampling or prospecting for deposits.

    (2)

    "Overburden" means the earth and materials removed in strip mining.

    (3)

    "Area of land affected" means the area of land from which overburden is removed or upon which it is deposited.

    (4)

    "Pit" means the area left uncovered by the removal of overburden or commercial deposits.

    (5)

    "Operation" means the process of strip mining and the premises, facilities and equipment used in mining a designated strip mine area.

    (6)

    "Operator" means any person, as defined in subsection (3) of section 1.01, Florida Statutes, conducting an operation.

    (7)

    "Board" means the Board of County Commissioners of Nassau County.
